David of Blue Mass. Group has written an excellent analysis of the legal issues and the politics of the anti-gay marriage amendment proposed to be placed on the Massachusetts statewide ballot in November 2008. He confirms that the legal reasoning behind the decision of Attorney General Tom Reilly to certify the petition is sound, even though he - as well as the other Democratic candidates for Governor - disagree with the petition on the merits. I do think that Reilly will be weakened in his Gubernatorial primary contest with Deval Patrick and (possibly) Bill Galvin by his agreeing to certify the petition. The extent of this weakening is - at this point - anybody's guess, but in a close race it could ultimately be decisive.
